1. Introduction

Welcome to SkySenders.ai ("we", "us", "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, applications, and related services ("Service"). By using the Service, you agree to these Terms. If you do not agree, you may not use our services.

2. Legal Entity

3. Eligibility

You must be at least 18 years old to use our Service. By registering, you confirm that you are legally permitted to use the Service for business or professional purposes.

4. Services Provided

SkySenders provides cold email infrastructure, including:

• Domain purchase and registration via Namecheap
• Mailbox and server setup
• Email campaign tools and dashboards
• Programmatic API access and integrations

5. Subscription and Payment

• Our services are offered under monthly subscription plans (e.g., Starter, Growth, Essentials, Custom Enterprise).
• A one-time setup charge is applied at the time of domain/server provisioning.
• Recurring charges begin as per your selected plan.
• All payments are processed securely via Stripe.
• Subscriptions renew automatically unless canceled prior to the billing date.
• No refunds are provided for partial use or early cancellation.

6. Cancellations and Data Deletion

You can cancel your subscription at any time from the dashboard. Upon cancellation:

• Your account, mailboxes, and domain routing will be deactivated.
• All associated data will be permanently deleted and cannot be recovered.

Note: Please export your data before initiating cancellation.

7. Fair Usage Policy

You agree not to:

• Send spam or violate applicable anti-spam laws
• Exceed the API usage rate limit of 60 requests/minute
• Use the service for phishing, malware, or prohibited content

Violations may result in account suspension or termination without refund.

8. Support

We offer chat-based customer support. Response times are typically 24–48 business hours.

9. Availability and Downtime

While we aim for high availability, we do not guarantee uninterrupted access. In case of downtime, we will make reasonable efforts to restore service within 2–4 hours.

10. Intellectual Property

All code, branding, and service content is owned by or licensed to SkySenders. You may not reuse, duplicate, or reverse-engineer our materials without explicit permission.

11. Limitation of Liability

To the extent permitted by law, we are not liable for indirect or consequential damages, including data loss, service interruption, or business losses.

12. Modifications to Terms

We may update these Terms at any time. Revisions will be posted here. Continued use of the Service after changes implies acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Gujarat, India. Any disputes will be resolved in the courts located in Gujarat.
